Kapoor entersinto a contract with him for purchasing rice consignments worth 3 lakhs to be delivered on 17lh of September, 2014 in one batch all together. However, on the said day, Mehta delivers the rice consignment worth Rs 2 lakhs and requests Mehta to give him another 4 days to deliver the rest. Kapoor accepts the consignment but remains silent on the extension of the time. After 4 days when Mehta delivers the rest of it, Kapoor rejects saying that Mehta has breached the contract.
