CONSTITUTIONAL DEVELOPMENT OF INDIA



Ans.

              Indian Constitution is regarded as the living document because the dynamic spirit it has embraced in itself is the continuing force to keep body polity intact at its foundation and at the same time amply displaying flexibility to condition in accordance with the flow of things as and when the situation is warranted. The  Constitution, though a written lengthy document, is not just the manual prescribing articles for the system to function but it deeply reflects the spirit of  cultural and civilizational continuity of the country as well which is all inclusive and secular pervasive of each and every page thereof..  The beginnings of the harsh acts are primarily traced in the wake of Sepoy Mutiny, post 1857, when India had already woken up to battle cry, with Mangal Pandey paving the way. However, East India Company did also try hard to achieve a common commercial goal and strike a middling pact. During the ongoing Company administration in the 18th century, they had introduced some substantial acts, primarily based on regulations and lands.The history of the Constitutional development of India can be traced back to the Regulating Act of 1773, which for the first time made the provision for the post of Governor-General in India. However, the year 1858 serves as watershed when the Indian Administration came was at its pinnacle.

Thus the period of British constitutional development experiment in India can be divided into two phases

A.      Phase 1- Constitutional experiments during the rule of the East India Company ( 1773 –1857 )

B.      Phaser-2- Constitutional experiments under the British Crown ( 1857-1947 ).
